Not long ago, the Ministry of Environmental Protection issued the Interim Provisions on the Administration of Pollutant Discharge Permits, specifying the provisions on the application, issuance, implementation and supervision of pollutant discharge permits. According to the regulations, self-monitoring by polluters is an important item in the discharge permit, and the self-monitoring program and information record requirements should be clearly defined in the application and verification process. It is not difficult to see that pollution source monitoring is an organic part of pollutant discharge permit system. It is of great significance to consolidate the foundation of pollution source monitoring to support the effective implementation of pollutant discharge permit system.
First of all, we should improve the technical system and management system of self-monitoring, and support polluters to self-certify and abide by the law.
First, a technical guide system for self-monitoring by polluters will be established to provide support for the application and issuance of emission permits. In light of the specific conditions of industrial production and pollution discharge, guidelines will be formulated for different industries to provide guidance for self-monitoring of enterprises in industries with large differences. The self-monitoring guide for industrial pollutant discharge units includes two core contents: self-monitoring program, information record and report. Based on the connection with the pollutant discharge permit list and the analysis of industrial emission status, at least 26 key industry guidelines such as paper making, thermal power, steel and cement should be studied and formulated.
Second, improve the technical standards related to pollution source monitoring to provide technical basis for monitoring activities. According to the preliminary combing of the current effective and currently being revised technical specifications and methods, automatic monitoring of heavy metals, exhaust gas VOC, mercury automatic monitoring has not been standardized support. Among 173 kinds of waste water indexes and 122 kinds of waste gas indexes involved in the current discharge standards, there are still about 14 kinds of waste water pollutants and 40 kinds of waste gas pollutants that have neither standards nor project development. It is necessary to conduct research and evaluation as soon as possible to start the standard development of relevant norms and methods. In addition, it is necessary to further strengthen the automatic monitoring of pollution sources, the development of remote sensing and telemetry for qualitative law enforcement, rapid detection, accurate and quantitative portable field monitoring equipment and standards, and strengthen the development of monitoring equipment and standards for unorganized emission of waste gas.
Third, we revised the Measures for Self-Monitoring and Information Disclosure of Key State Monitoring Enterprises (trial) to improve the self-monitoring management system. Measures for Self-Monitoring and Information Disclosure of State Key Monitoring Enterprises (trial) has been unable to meet the current demand for self-monitoring and management, and should be revised. It is suggested to link up with the upper Law, especially with the requirements for the implementation of the emission permit system, so as to concretize the requirements of the Upper Law and facilitate the operation and implementation of enterprises; It is suggested to connect with the self-monitoring guidelines and peel off part of the technical requirements; It is suggested to strengthen the requirements of self-monitoring quality management and supervision. Only when the quality of self-monitoring data is guaranteed, can the implementation of pollutant discharge permit system be effectively supported.
Second, we need to improve the pollution source monitoring and management system and support the discharge permit system, supervision and law enforcement.
First, we should improve the pollution source monitoring and management system and form a hierarchical management framework. According to the "Guidance on the Pilot Reform of the Vertical Management System for Monitoring, Supervision and Law Enforcement of Environmental Protection agencies at and below the provincial level", existing environmental monitoring agencies at the county level will be put under the management of prefecture-level environmental protection bureaus and their sub-bureaus, and their main function will be to monitor law enforcement. The main task of law enforcement monitoring of pollution sources should be undertaken by municipal environmental protection departments and monitoring organizations. Prefecture-level environmental protection authorities and monitoring agencies shall, in accordance with local pollution prevention and control requirements, be fully responsible for law enforcement and monitoring of all key pollutant-discharging units within their jurisdiction. Provincial-level environmental protection authorities and monitoring agencies have the responsibility of monitoring, guiding, supervising and managing law enforcement at prefecture-level level. Quality supervision and inspection should be carried out on law enforcement monitoring at prefecture-level level, and evaluation and supervision should be carried out on law enforcement monitoring at prefecture-level level by sampling some key pollution sources. The state supervises the implementation of law enforcement monitoring by provincial and prefecture-level environmental protection authorities and monitoring agencies.
Second, we will improve the monitoring and management mechanism for pollution sources and form an effective linkage between monitoring and supervision. In line with the needs of environmental law enforcement, it jointly carries out on-site inspection of pollution sources and law enforcement monitoring activities with environmental supervision departments, and directly provides technical support for environmental law enforcement. The monitoring department shall carry out supervisory monitoring on key pollutant discharge units within its jurisdiction in a planned way, and the monitoring information acquired shall be shared with the environmental law enforcement department in a timely manner to provide basic information for environmental law enforcement and permit management. Special monitoring should be carried out in accordance with the environmental management needs. Environmental protection authorities at all levels should carry out special monitoring activities for the purpose of supporting current status research, policy assessment and technical research according to the environmental management needs at the same level, aiming at specific problems, so as to provide services for scientific decision-making of environmental management.
Third, strengthen the supervision and management of self-monitoring and form a law enforcement monitoring pattern based on self-monitoring. Government departments should strengthen the supervision and inspection of the self-monitoring of pollutant discharge units, pay attention to the investigation and punishment of malicious falsification of data, but also pay attention to the quality management of self-monitoring data, so as to improve the quality of self-monitoring data. Government departments should strengthen the normative evaluation of pollutant discharge units' monitoring behavior and systematically inspect the compliance of their own monitoring data. From a professional point of view, the standardization, quality assurance and implementation of quality control measures in the whole process of self-monitoring should be inspected, so as to systematically evaluate the quality of data monitored by pollutant discharge units.
Third, a pollution source monitoring data management and sharing system should be built to support the construction of a pollution discharge permit platform.
At present, the China Environmental Monitoring Station is building a national pollution source monitoring data management and information sharing system to collect and manage data from enterprises and supervisory data from environmental protection departments in a unified manner, and make them available to the public. The main goals of this system are as follows: the state has delegated the power to monitor pollution sources. The unified collection of monitoring data by the state can be used as an important means to supervise local governments and polluters to carry out self-monitoring and law-enforcement monitoring; Through unified information collection, unified coding and data interconnection with the license issue management platform, the monitoring data is directly used as the basis for assessing the emission of enterprises in accordance with the license; As a technical support for the Ministry of Environmental Protection to implement the requirements of the new Environmental Protection Law to uniformly release monitoring information of pollution sources; To provide basic data for the revision and evaluation of the national emission standard system and the revision of the emission coefficient system of pollution sources.
Pollutant source monitoring information is an important part of pollutant discharge permit management. Meanwhile, pollution source monitoring is a relatively complex and independent system, which can be developed as an independent module. This system is connected with the license management platform, which not only serves as an important means to supervise the self-monitoring of polluters and law enforcement and supervision of local governments, but also provides basic monitoring data for license management. In 2017, the system will be connected across the country to collect data from companies that have conducted self-monitoring. In the future, we will cooperate with the progress of license issuance, and gradually bring the monitoring data of various industries in the license directory into the network scope.
